DATENSCHUTZ-INFORMATION und ZUSTIMMUNGSERKLÄRUNG

Mit der Unterzeichnung des DCFs (1. und 4.) bestätige ich, dass ich ausreichend über meine RECHTE & PFLICHTEN, FORSCHUNG sowie über die VERARBEITUNG der PERSONENBEZOGENEN DATEN informiert wurde. Des Weiteren verpflichte ich mich, die Anti-Doping-Regelungen meiner zuständigen Anti-Doping-Organisation, die Regelungen des Anti-Doping Bundesgesetzes 2021 (ADBG 2021) und den Welt-Anti-Doping-Code (the „Code“), welcher von Zeit zu Zeit aktualisiert wird, anzuerkennen und einzuhalten.

RECHTE & PFLICHTEN

Als Sportler:in habe ich folgende Pflichten:

• Pflicht, sich vom Zeitpunkt des Erstkontakts durch den:die DCO / DCO-Assistent:in / Chaperon bis zum Ende des Verfahrens der Probennahme unter direkter Beobachtung des DCOs / DCOs-Assistent:in / Chaperons zu bewegen;
• Pflicht, sich auszuweisen;
• Pflicht, sich unverzüglich in der Dopingkontrollstation einzufinden;
• Pflicht, nach der Aufforderung zur Dopingkontrolle den Ersturin abzugeben;
• Pflicht, am Verfahren der Probennahme mitzuwirken;
• der Verzehr von Nahrungsmitteln und/oder Flüssigkeiten erfolgt auf eigenes Risiko;
• keine Flüssigkeiten übermäßig zuzuführen, da dies eine ordnungsgemäße Probennahme verzögern kann;

Als Sportler:in habe ich folgende Rechte:

• Recht auf eine Begleitperson (Vertrauensperson) und gegebenenfalls eine:n Dolmetscher:in;
• Recht auf zusätzliche Informationen über den Vorgang der Probennahme;

Als Sportler:in kann ich folgende Ersuchen an den DCO richten (im Ermessen des DCO):

• Ersuchen um ein späteres Erscheinen in der Dopingkontrollstation aus berechtigten Gründen (Siegerehrung, Medienverpflichtung, andere Wettkämpfe, Abwärmen, notwendige medizinische Behandlung, Aufsuchen Vertreter:in/Dolmetscher:in, Beschaffung Lichtbildausweis, Beendigung einer Trainingseinheit, oder andere angemessene Umstände nach Ansicht des DCO);
• Ersuchen um Modifizierungen für Sportler:innen mit Beeinträchtigungen und/oder um Modifizierung für Minderjährige;

FORSCHUNG

Ihre Probe sowie die aus Ihren personenbezogenen Daten abgeleiteten Daten können auch für andere Zwecke wie die Anti-Doping-Forschung oder zur Verbesserung und Überprüfung der Qualität von Anti-Doping-Nachweisverfahren verwendet werden, wenn die Bedingungen von Artikel 6.3 des Codes erfüllt sind. Diese Maßnahmen dürfen nur ergriffen werden, wenn die personenbezogenen Daten mit jenen der Probe nicht in Verbindung gebracht und zurückverfolgt werden können, wenn die Forschungs- oder Qualitätsverbesserungsstudie mit geltendem Recht und international anerkannten ethischen Forschungsgrundsätzen übereinstimmt und wenn Sie bei Forschungsprojekten Ihre gesonderte und freiwillige Zustimmung zur Verwendung Ihrer Probe in der Forschung erteilt haben.

VERARBEITUNG der PERSONENBEZOGENEN DATEN

Die NADA Austria darf personenbezogene Daten - Personalien; Aufenthaltsort; Identitätsnachweis; Informationen zur Analyse (Code, Typ, Höhenlage oder Umweltexposition, eingenommene Medikamente/Nahrungsergänzungsmittel oder Bluttransfusionen); und Laborergebnisse der Probe(n) - von Sportler:innen und von anderen, am Dopingkontrollverfahren beteiligten Personen, entsprechend dem ADBG 2021, verarbeiten, soweit dies zur Planung, Koordinierung, Durchführung, Auswertung (inkl. Athlete Biological Passport) und Nachbearbeitung von Dopingkontrollen und zum Zweck einer effektiven Anti-Doping-Arbeit erforderlich ist.

Diese Daten können via ADAMS an die WADA, den zuständigen internationalen Sportfachverband, die weiters zuständige Anti-Doping-Organisation, das IOC und IPC, beauftragte Dritte und andere Dienstleister:innen sowie an das von der WADA akkreditierte Labor einschließlich der Athlete Passport Management Unit übermittelt werden.

Diese Daten werden in einer pseudonymisierten Form via ADAMS übermittelt. NADA Austria behandelt diese personenbezogenen Daten vertraulich und stellt sicher, dass sie beim Umgang mit diesen Daten in Übereinstimmung mit der DSGVO, geltendem nationalen Datenschutzgesetz und dem Int. Standard for the protection of privacy and personal information (ISPPPI) handelt.

Die Daten werden vernichtet, sobald sie für diese Zwecke nicht mehr benötigt werden. Ihnen stehen bezüglich Ihrer bei uns gespeicherten Daten grundsätzlich die Rechte auf Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit, Widerruf und Widerspruch mit den im ADBG 2021 genannten Einschränkungen zu.

DATA PROTECTION INFORMATION and ATHLETE’S CONSENT FORM

By signing the DCF (1. and 4.), I confirm that I was informed sufficiently about my RIGHTS & RESPONSIBILITIES, RESEARCH and the PROCESSING of PERSONAL DATA. Moreover I confirm that I know and adhere to my Anti-Doping Organization's Anti-Doping Rules, the rules of the Anti-Doping Federal Act 2021 (“ADBG 2021”) and the World Anti-Doping Code (the "Code"), as amended from time to time, and that I undertake to abide by them.

RIGHTS & RESPONSIBILITIES

As an athlete I have the following duties:

• Responsibility to remain within direct observation of the DCO / DCO-assistant / Chaperone at all times from the point initial contact is made by the DCO / DCO-assistant / Chaperone until the completion of the doping control process;
• Responsibility to produce identification;
• Responsibility to report to the doping control station immediately after notification;
• Responsibility to provide the first-urine after notification to doping control;
• Responsibility to comply with sample collection procedures;
• the consumption of food and/or liquids is at the user’s own risk;
• Not to hydrate excessively, since this may delay the production of a suitable Sample;

As an athlete I have the following rights:

• Right to be accompanied by a representative and/or an interpreter;
• Right to request additional information about the doping control process;

As an athlete I can make the following requests to the DCO (at the discretion of the DCO)

• Request a delay in reporting to the doping control station for valid reasons (media commitments, further competitions, warm down, necessary medical treatment, locating representative/interpreter, obtaining identification, completing training, or other reasonable circumstances as determined by the DCO;
• Request modifications for athletes with impairments and/or modifications for athletes who are minors;

RESEARCH

Your sample as well as data derived from your personal information may also be used for secondary purposes such as anti-doping research or to improve and verify the quality of anti-doping detection methods if the conditions of Code Article 6.3 are met, namely: measures are adopted to ensure your personal information and sample cannot be linked to each other and cannot be traced back to you; the research or quality improvement study complies with applicable law and internationally recognized ethical research principles; and, for research projects, you provided your separate – and optional – consent for the use of your sample in research.

PROCESSING of PERSONAL DATA

NADA Austria is allowed to process personal data - Personal details; Whereabouts; identification-information; sample analysis information (sample code, sample type, altitude levels or exposure to extreme environmental conditions, recent medications/supplements or blood transfusions); and laboratory results from the sample(s) - of athletes and other persons, who are involved in the doping control process, according to the Federal Anti-Doping Act 2021, where necessary in order to plan, coordinate, conduct, assess (including ABP) and rework doping controls and for the purpose of the efficient anti-doping work.

This data will be transmitted via ADAMS to WADA, the competent international federation, other ADO responsible for the athlete, the IOC and IPC, delegated third parties and service providers and to WADA-accredited laboratories including the Athlete Management Passport Unit. This data is transmitted in a pseudonymized form via ADAMS.

NADA Austria will treat this personal data in confidence and ensures that the handling of the personal data is in line with the GDPR, applicable national data protection law and in accordance with the International Standard for the protection of privacy and personal information (ISPPPI).

Your data will be deleted as soon as they will have served the purpose indicated. In relation to your personal data, you have the right of access, rectification, erasure, restriction, data portability, revocation and opposition with restrictions according to the Federal Anti-Doping 2021.
